Name of Participant: ___________________________________________  (Print please)                                 TO: BrittiCares International  ASSUMPTION OF RISKS: I, the undersigned, am aware that the activities of accepting an invitation and attending a public  Sporting event (“the Activities”) involve inherent risks, dangers and hazards including; personal injury, potential exacerbation of existing health issues, and others.  I freely accept and fully assume all such dangers and risks and the possibility of personal injury, death, property damage or loss resulting therefrom. RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:  In consideration of BrittiCares International inviting me to the 4th annual Brittiana “Smile For Life” 5k run/walk to benefit children’s cancer, located at Pacific Palisades High School, to participate in activities as I choose, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against BrittiCares International (BC) and all its affiliates, directors, officers, employees, agents, and representatives, and any volunteers in any way associated with the Activities, (all of whom are hereinafter collectively known as “the Releasees”).

2. TO RELEASE THE RELEASEES FROM ANY AND ALL LIABILITY for any loss, damage, injury or expenses that I may suffer or that my next of kin may suffer as a result of my Participation in the Activities due to any cause whatsoever. TO HOLD HARMLESS THE RELEASEES from any and all liability from property damage or personal injury to any third Party, resulting in my participation in the Activities or use of Pacific Palisades facility, and or any activity or item linked to, or used by for or at the facility of Pacific Palisades High School.   Release of Liability shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns in the event of my death.

3. Any disputes that may arise between myself and BrittiCares International (BC) regarding the Activities or this agreement shall be submitted to binding arbitration in accordance with Code of Civil Procedure

Sections 1280 through 1294.2, such arbitration to take place in Los Angeles, California. The Arbitrator’s award will be final and binding on the parties, and judgment may be entered upon it by a court of competent jurisdiction.

4. If any provision of this agreement is determined illegal or unenforceable, then, that determination will not affect the validity of the remaining provisions.

I have read and understood this Assumption of Risk and Release of Liability prior to signing it and I am aware that by signing this document I am waiving certain legal rights which I, or my Heirs, next of kin, executors, administrators and assigns may have against the Releasees.   (Participants under 18 years of age must have a parent or guardian sign this document.) As the parent or legal guardian of the above Participant, I hereby waive any and all claims, Participant or I may have against RNK or BC arising from the Participant’s participation in the Activities. Furthermore, I hereby indemnify and hold harmless RNK and BC from any and all such claims.
